I heard that at a stakeholder meeting on Nov. 7, 2017, the Immigrant Investor Program Office (IPO) made it clear that when filing an I-924 exemplar, it would make their life easier if a cover letter listing all I-526 petitions filed under that exemplar were included. I was one of the last investors in an EB-5 project before it got I-924 exemplar. I filed my petition in December 2017 and my I-526 is still pending. Should I request my regional center to inform IPO that my petition belongs to the exemplar projects to potentially speed up the processing of my I-526?

Immigration Attorneys DirectoryGenerally, most RCs will prepare a notice packet to attorneys who file individual EB-5 investors'' I-526s and your attorney should interfile this in your pending I-526 case. However, it will not necessarily speed up the processing times. Your case is not outside the processing times, as they are currently about two years.

Immigration Attorneys DirectoryThere is nothing wrong in contacting your regional center so as to ascertain if your petition and its accompanying information had been included in the I-924 package. However, if your petition had not been included asked why not. Also, you can request that the situation be rectified.

Immigration Attorneys DirectoryAs an individual I-526 investor it would be entirely up to the regional center whether or not it wishes to supplement its I-924 exemplar application. While you certainly could bring your suggestion to the attention of the regional center and it may choose to do so, as a practical matter, your I-526 petition will be adjudicated on its own merits.

Immigration Attorneys DirectoryThat would be a good place to start or talk to the attorney who filed your I-526 to do an interfiling. Congrats on the exemplar approval!

Immigration Attorneys DirectoryAnything that makes an adjudicator's job easier is a plus and most RCs/law firms will prepare this anyway.
