I filed my I-526 with an exemplar regional center project about two months ago. I also requested expedited processing. However, I have not received the receipt notice and the check for the filing fee has not been deposited. Is this normal? How long should I wait before I take any actions?

Schedule a Free Consultation with Top EB5 Visa AttorneysGive it at least 90 to 120 days. Nevertheless, you cannot take any actions at the USCIS without the proof that your I-526 package was filed with them. You will need the receipt number that is assigned when the case is entered in the system.

Schedule a Free Consultation with Top EB5 Visa AttorneysDefinitely not normal. If the I-526 was filed by priority mail or FedEx, make sure it was delivered to USCIS. Without a receipt notice or cashed filing check, which usually has the receipt number on the back of the cashed check, you are not going to be able to track your petition. You may have to re-create and refile the petition. Most filing fee checks are cashed within two weeks and the receipt notices are sent out. Two months is too long.

Schedule a Free Consultation with Top EB5 Visa AttorneysThis sounds longer than normal. Usually, fee payment should clear within a couple of weeks. Receipts may be delayed but normally, it takes about two to four weeks to get receipts. If the check has not cleared yet, it is possible filing may have been rejected and will be returned. Check with your immigration attorney.

Schedule a Free Consultation with Top EB5 Visa AttorneysThat is longer than normal. USCIS has been taking longer and longer to send receipts, but two months seems like a lot. Unfortunately there isn't much you can do without a receipt number from USCIS.

EB-5 Broker DealersThis is clearly not normal. The usual time for receiving the I-526 filing receipt is two weeks. It is very possible that your application was not received by USCIS. The fact that your check is not cashed leads me to believe that most likely that is the case. You attorney should contact USCIS immediately.

Schedule a Free Consultation with Top EB5 Visa AttorneysYou should have received the receipt notice and the filing fee check cleared with in a couple of weeks of filing. If it has been two months it may be that the filing has been rejected. You should have your attorney look into the filing to see if all the required documents were filed correctly and properly signed, etc.

Schedule a Free Consultation with Top EB5 Visa AttorneysYou clearly should've received your receipt notice if you filed two months ago, whether you requested expedited processing or not. This is not normal. Through your attorney, or by directly contacting USCIS online, you should follow up to request a copy of your receipt. You should make sure that you've not changed addresses, as sometimes the address will go to your old address, even if you filed a change of address with USCIS.

Schedule a Free Consultation with Top EB5 Visa AttorneysThis is not normal! Generally you should have a receipt from USCIS within two weeks. If they have not cashed your check then it is possible they do not have your application. I would recommend you speak with your investment immigration attorney immediately.

Schedule a Free Consultation with Top EB5 Visa AttorneysNot normal, but not unheard of. Usually receipt comes within two weeks. Assuming your attorney used their check for the filing fee, you should check to see if the check was cashed.
