I submitted my I-829 application and received a notice that my form I-829 was received. It said: “Petition by Entrepreneur to Remove Conditions on Permanent Resident Status. We will prepare your case for officer review.” My question is, what is the next step and how long it will take?

Immigration Attorneys DirectoryThe next step is waiting until U.S. Citizenship and Immigration Services makes a decision on the I-829 petition. The current processing for an I-829 petition is approximately two years.

Immigration Attorneys DirectoryAfter you submit your I-829, the next step will be an approval to remove the condition. Presently it is taking almost two years to get those cases approved. In the meantime, if you need to travel, you should request an appointment with the nearest USCIS office through the Infopass system so that they may stamp your passport extending your green card.

Immigration Attorneys DirectoryI-829 adjudications are slow. Anticipate at least about two years. If you met the job and capital sustainment requirements, expect an approval. If not, you will get a request for more evidence, a notice of intention to deny or, if very poorly presented, possibly even a denial (but that is only for bad cases).

Immigration Attorneys DirectoryAfter you file your application to remove conditions on Form I-829, as you say, you will receive a notice indicating receipt of same. There is absolutely nothing for you to do at this stage, but be patient. It can take many months before your application is adjudicated.

Immigration Attorneys DirectoryUSCIS will process you for biometrics (fingerprints) by sending you a biometrics appointment notice. Your receipt notice extends your status for one year and you may work and travel with this notice and your valid foreign passport.

Immigration Attorneys DirectoryThe current processing time for I-829 is 30 months. Your conditional green card status continues until its adjudication, and everything you were required to do understands that status is what you should continue doing.

Immigration Attorneys DirectoryThe current processing times posted by USCIS are 30 to 39 months to adjudicate an I-829. After submitting the I-829, you may receive a request for evidence if USCIS believes you need more documents. Of course, I have not seen what was filed. You must demonstrate you invested the requisite amount and that 10 jobs were created during the conditional period or that they will be created within a finite period of time. You also did not say if you had a regional center or individual investment.
