What if the primary excludes the dependent in the I-829?

What could happen if the primary investor refuses to include the dependent spouse in removing the conditional green card? Even if they file separately, what can be done when the primary investor refuses to give any information needed to file separately? Would this mean that the dependent will have to leave the U.S. and could lose custody of their child?
