Is purchasing real estate an EB-5 investment?

I see a few real estate development projects selling apartments that supposedly qualify as an EB-5 investment. As far as I know, this is not acceptable under the program’s rules, but there seem to be attorneys who approve this. Is there a loophole, or are investors in these projects putting themselves at risk? I would appreciate your guidance.

You need an investment that will create ten full-time jobs and most small apartment complexes won’t do this.

This should be a question for your own attorney who knows the situation in totality. Real estate project by itself is not an operational business that will hire 10 permanent jobs for each investment. How the project is structured to meet the requirement is the art of deal. No attorney has the power to approve it or not. With that being said, there is no straight yes or no answer. To do it or not to do it is the whole point why you should have an attorney on your side. You should never trust any "approval" from an outside source who does
not know the whole story. You should trust your attorney or hire one you trust.

Your investment must create 10+ jobs - this typically isn't doable with a simple real estate investment, however, depending on the company business model there could be a need for future employees if the business is aimed at property development, management, etc.
