How does a criminal record affect a possible EB-5 application?

I have been studying the EB-5 visa option, but I am concerned about a 15-year-old conviction for driving under the influence and misconduct. I had to pay a fine and could not drive for a year, but I did not go to jail. I have no other criminal record. How can this mistake from the past affect my EB-5 application? Do I have to present documents explaining the reason for this conviction or something else showing I have no other convictions?

A single DUI more than 15 years ago should not on its own be a problem if you are not a drunkard. But you indicate a possible second conviction for misconduct so need to get the final disposition of these cases and have it evaluated to see if you are criminally inadmissible. Also, if you failed to disclose these that can be seen as visa fraud.

If that is all on your record and you can show you complied with the Court terms, you should not have a problem with your permanent residency based on EB-5 investment.
