How could the regional centers audit affect my EB-5 investment?

I learned that many regional centers are going through an auditing process. I think this is great because it tells me there’s preoccupation from the authorities about the program. But could this process affect how the regional center manages my investment? I am starting to look at projects and regional centers with the help of my attorney and she tells me the process is completely parallel to how these organizations work. Can I ask the regional center I choose if they are being audited? I really would like to reduce risk as much as possible, and I’m concerned about anything that could affect my application. Thank you for understanding.

The audit process is relatively new and should provide some level of protection, but its best to work with an experienced team that can provide some level of due diligence as to not only the RC but also the specific project you have invested in to reduce risk.

You still need to assess the Regional Center for suitability as an investment and know their immigration history of prior I-526 and I-829 approvals. There are companies and individuals that you can hire to do the due diligence. Make sure they are approved by the SEC.

All RCs are going to be audited. It's a normal process now. It's fair to ask your RC if they're prepared or what steps they've taken to deal with audits though.
