How can my U.S. business become a project to get EB-5 investors?

I have businesses in Latin America and I would like to look at the possibility of raising capital to expand my business to the United States. Since the EB-5 visa draws investors from Latin America, could I open a company in the U.S. and raise capital with Latino investors directly, so they can use my business to get their EB-5 visa? I would be giving jobs to more than 10 people directly because that is the whole point of opening up operations in the U.S. Have other people done something similar?

You need to either qualify as a regional center or affiliate with one and need to have the project approved based on the fact you will directly or indirectly create ten new jobs for every specific investor.

Definitely may be doable – we would need to work through the details with you to properly advise.

Yes, absolutely. We have assisted several company owners from Venezuela and Mexico in this same way. I am happy to discuss any time to help you better understand the EB-5 program and structure a compliant deal.

Yes, this is possible through “direct” EB-5 program. A US based business can be funded by one foreign national investor seeking EB-5 resident status. If you need to raise funds from more investors (who would seek EB-5 resident status), a specific structure can be put into place… but the general rule is 1 business, 1 EB5 investor.
