How can I trace cash transactions as part of my EB-5 source of funds?

One part of my EB-5 investment (7-8%) came from my parents, who live in my home country. It is becoming difficult to trace the source because of the prevalence of cash transactions in India. Will this be a definite roadblock for my I-526 approval? What can I do to prevent it?

There may be solutions – was the money from your parents a loan or a gift? We can prepare a Declaration accordingly. How did your parents earn their money – can we show income from a business, investment, gift or whatever?

If you find it difficult to trace the source of your parents’ money, do not use it as part of your source of funds. All EB-5 funds have to be legitimate and explainable.

Have notarized statement of each cash handled in the chain of custody.

We get this question a lot. You are not alone. We strongly suggest that you work with an experienced immigration attorney who can explain your specific source of funds challenge. Remember, the law states that, more likely than not, the source of your funds must be from lawful means. In the last few years, the scrutiny on this has risen considerably due to inadequate explanation of the source of funds. As a general rule, there is nothing wrong with using funds obtained from cash transactions as long as the narrative explaining it is well-written. Best of luck!

There are varying levels of evidentiary authority to support an EB-5 source of funds petition, ranging from government- or bank-issued documents at the higher end, down to self-serving statements at the lower end. An experienced EB-5 immigration attorney can work with your team to assemble the strongest available document record in support of your EB-5 investment immigration.
