How can I get my EB-5 visa before my H1-B status expires?

I’m working in the United States, and my H1-B status expires in November of next year. I’m already at the 6-year extension limit. Would I have enough time to go through the EB-5 process before my status expires?

Depends on whether your Priority Date will be current before then so you can file the I-485. This is not a status but will allow you to remain and apply for interim benefits to work and travel.

If you are from India or China, you need to file very soon because those countries will become backlogged, otherwise most eligible applicants will get a new 5-year work card 3-4 months after filing an eligible adjustment of status application.

You would only be eligible for apply for residency (apply to adjust status or file an I-485) before then if your priority date, or date of filing of your I-526, is current according to the visa bulletin ("C" or the date has been reached), depending on your nationality and EB-5 category.
