I was planning on applying for the EB-5 visa this year. However, I just learned that some regional centers have been terminated because they didn’t pay an important fee. As I continue studying my options, I would like to know if I can ask for proof that they paid the administrative fee and other documentation proving they are complying with the law before becoming their client. What other way do I have to find out if the regional center of my choice is meeting all legal requirements? I don’t want to live the experience of having my regional center terminated in the middle of my application because it didn’t meet the law.

Due Diligence means to verify everything the regional centers present and more. In my opinion, track record is the only reliable means of knowing whether you can rely on a particular investment organizer. I suspect that a number of the recent terminations is a result of the almost 2-year hiatus that was imposed on them while Congress re-wrote the law authorizing the Regional Center program. That 2-year pause, plus the substantial fee increases, likely caused a number of Regional Centers to voluntarily cease operation. You definitely can (and should) ask the Regional Center for documentation that it is in compliance with the USCIS requirements related payment of the administrative fee. You can even ask to see a copy of the payment receipt. However, this is an annual administrative fee. You will need to request this for each year that your EB-5 case is languishing in the long processing queue.
