I filed my I-526 form in November 2019. I am not from India or China. When could I expect approval? What petitions are being approved now?

Immigration Attorneys DirectoryIf you have not yet heard, you will hear very soon. USCIS is prioritizing these cases.

Immigration Attorneys DirectoryEB-5 petitions are being adjudicated at a faster clip than in the past few years, but it is difficult to estimate when a November 2019 petition will be adjudicated. It is still within regulatory processing times and while IIUSA is trying to gather data there are too many unknowns to predict timing. Regardless, the faster clip of processing I-526 petitions is favorable.

Immigration Attorneys DirectorySee the processing times here (uscis.gov). It also depends on what type of filing – Regional Center vs. direct project.

Immigration Attorneys DirectoryIt all depends. Generally, it is about 3-4 years. However, after the new RIA regulations which went to effect in 2022, we have been seeing faster processing time for older petitions like yours. If you have the filing date on your receipt you can go to the USCIS site and put in your receipt date and get an exact answer (https://egov.uscis.gov/processing-times). If it has been beyond the processing time, then you can make an inquiry.

Immigration Attorneys DirectoryYou indicated that you filed your I-526 petition in November 2019. As of March 5, 2024, USCIS is reporting that 80% of the I-526 cases are processed within 55.5 months. Your case has been pending now for 51 months. It appears that your case should be reviewed in about 4 to 5 months.

Immigration Attorneys DirectoryHave you reviewed the USCIS processing times on the tools section of their website? If no, thats the place to start. That should give you an idea. If the processing times has been exceeded, then you can put in your receipt date and that will tell you when you can do an inquiry. If that's not satisfactory, then your last option would be to litigate against the US government. Also, remember, you also have to look at the State Dept Visa Bulletin. Do you have a lawyer who is assisting you with your case? If so, these questions should be directed to your lawyer.

Immigration Attorneys DirectoryThe government processing times currently show 55.5 months of waiting. If your application was filed in 2019, my guess is that you should hear back within the year. You can also enter your receipt number in the below link to see whether your case is still within processing time (uscis.gov).

Immigration Attorneys DirectoryEarliest 2025! If you are not a U.S. citizen or a lawful permanent resident, please download your I-94 form on every new entry to the U.S. https://i94.cbp.dhs.gov. There is an extremely high rate of error on these admissions and the I-94 governs your lawful stay in the U.S. (not your passport, not your visa, not your prior petition approval).
