How can I ensure that my EB-5 investment is returned per the contract after I-526 denial?

My I-526 was denied by USCIS in July 2023. I did not request an appeal and I want to receive my money back. I have a contract with the new commercial enterprise (NCE), which should have lent the money to a job creating entity (JCE). According to this contract, if my case is denied, NCE should pay the interest of the investment according to the current AFR until the whole amount is refunded. Unfortunately, the manager of the NCE does not answer his emails. How should I follow up with this case? What are the actions I can take?
