What is the I-526 processing time for a direct investment?

I am aware that if I go through regional centers, I would have to wait for about 12 to 16 months. I am also more comfortable starting my own business. I was wondering how long it takes for I-526 approval if I use the direct route.

Processing times vary depending on the region. Generally speaking, it does take less time for a direct investment to be processed vs. a regional center application.

Unfortunately, there is little predictability or clarity when it comes to processing times. Furthermore, USCIS estimates to not distinguish direct investments from regional center investments. From our experience the 12-16 month timeline is possible, but we have seen much shorter processing of certain cases. In either case, having experienced EB-5 counsel assist you with your application will avoid additional delays from requests for evidence or notices of intent to deny.

The processing times for an I-526 petition whether for a direct or regional center project is unpredictable. It may take several months to 12 months more or less. It may take less time for a direct I-526 petition as the business plan can clearly show how 10 direct full time jobs can be created.

USCIS has not distinguished direct investment vs. indirect one through a regional center in their processing time reporting, which is 18 months. However, I have heard that direct investment petitions were taking shorter time, although my clients have gotten their petitions approved within 12 months.

Whether the I-526 application is being reviewed for a Regional Center investment or a direct investment, the processing times are identical. Hopefully USCIS will work through its backlog and resume adjudicating these petitions in 4-6 months.

At the moment, direct EB-5 petitions are being processed within 4-8 months. Of course, there is no guarantee that by the time you file, the processing time will remain the same. That being said, given your desire to actively manage your business, a direct EB-5 may be the best path for you.
