My boyfriend and I both have Chinese passports. I am studying in the United States, and he is studying in Canada. He doesn’t have a U.S. visa, so he can’t come to the U.S. Can we get married in Canada and then apply for EB-5 investment immigration as a married couple?

Find the Best EB5 Visa LawyersYes, you could. You would need to marry at least before the principal investor obtains permanent residence. The bigger question you may be facing is if you are the principal investor, and your fiancé is outside of the U.S. and cannot come to the U.S. then he may have to consular process after your application for a green card has already been filed in the U.S.
