The Department of State upheld the filing and final action dates in December’s visa bulletin for EB-5 investors in the Unreserved category for individuals from India and Mainland China.

The Visa Bulletin is a crucial source of information regarding immigrant visa availability. In the case of EB-5 investor visas, Chart B denotes the filing date to submit EB-5-related forms to the U.S. immigration agency, USCIS, while Chart A specifies the final action date for when the agency will issue a visa to an approved EB-5 investor. These dates are pivotal for processing immigrant visas and adjusting status in the U.S.

The final action date for Indian investors applying for EB-5 under the Unreserved category remains Jan. 1, 2022, with the filing date set for April 1, 2022. Meanwhile, the final action date for Mainland Chinese EB-5 investors is July 15, 2016, with a filing date of Oct. 1, 2016.

Unreserved includes all EB-5 applications outside of the new three set aside categories introduced by the EB-5 Reform and Integrity Act of 2022 (RIA) for specific types of investments.

The dates for EB-5 investors from Mainland China and India who apply under the set-aside categories (rural, high-unemployment areas, and infrastructure) are current. The same applies to EB-5 investors from all other countries.

Having current dates indicates that there are no backlogs associated with their nationalities and categories, leading to a more streamlined process for their applications.
