I’m considering starting my EB-5 visa application process in my home country and then relocate to the U.S. after obtaining conditional residency. However, I’d like to know if there’s a chance I can travel to the U.S. on a tourist visa and then start the application process when I’m there.

There are circumstances where you can enter as a business visitor to evaluate an investment and then lawfully change your mind after entry, but you cannot claim to be a tourist if your plan is to file for a green card.
