Will my failed EB-5 project affect my I-829 application?

I got my 2-year conditional green card. However, the EB project we invested in failed due to COVID-19, even though it created 10 jobs. Will this situation affect me when I file for my I-829?

If sufficient jobs were created your case can be approved even though the business failed.

Possibly – if money was invested and ten jobs were created you may still be entitled to the I-829 approval. Check with your EB-5 attorney.

It might… depends on the facts. If the jobs were created - and the evidence clearly shows that - you have a good chance of approval.
