What are the most common RFE reasons for EB-5 I-829s?

We are reaching our 21-month mark to be able to remove conditions on our EB-5 green card. I want to start preparing all documents that I will submit with the I-829 application to avoid a Request for Evidence. What supporting documents should I submit while filing I-829? What are the common reasons for I-829 RFEs?

I-829 preparation is a very important step to remove conditions on your conditional green card and must be handled by an experienced EB-5 immigration attorney. As an investor, you will provide your conditional green card (both sides), Schedules K-1. Other documents are generally provided by a Regional Center project. Issues for RFE generally include sustainment of capital and job creation.

We do provide information on the I-829 removal of temporary condition documents including, among others,: the prior I-526 approval, conditional green card front and back, corporate documents including the regional center/entity you invested in, certificate of formation, etc. This is a detailed process and requires a consultation fee as there is substantial documentation for the same.

The two critical issues are whether your funds were invested in the project and ten full time permanent jobs were created. It is possible they can look back at your source of funds but this is less common.

It’ll be better if you obtain assistance from a legal professional as I-829 is the last and crucial step to your permanent residency. Job creation is the focus in the I-829 stage.

You, as an investor, don’t have to provide any evidence except your K1s and a copy of the green card. All docs will be provided by the Project.
