Late Breaking News: DOS Changes Its Prediction on EB-5 Visa Numbers – Good News for Chinese Nationals

Charles Oppenheim, head of the Department of State’s Visa Office provided an update to Stakeholders on visa usage for the 2013 fiscal year.  Specifically, he noted that while he had previously predicted that the EB-5 numbers for China would be used up prior to year’s end, a recent slow down in applications received by the USCIS means that he no longer expects retrogression or a “cut off” date to be implement for Chinese EB-5 applicants.  This means that Chinese EB-5 applicants will not have to experience a back log in the category.

Likewise, Mr. Oppenheim noted that EB-5 visa usage has risen by 75%, compared to this time last year.  It is unclear at this time, how the transfer of EB-5 cases from the USCIS California Service Center to the new EB-5 program office in Washington, D.C. will impact visa usage.
