Some websites are saying that I-526 processing can be expedited and be adjudicated in three months. Is this correct? How can an investor apply for expedited processing?

Immigration attorneysYou would need to show something like a significant national interest in the investment. The nature of the investment would be the key. Just another hotel or multifamily housing might not cut it, perhaps if it is affordable housing in a low-income area though.

Immigration attorneysGenerally, there is no expedited processing per se in EB-5 petition processing. Get more facts on any regional center you are working with and ensure you are getting nothing but real information. In some rare cases, expedited processing is available upon request and if the numerous criteria are met. Advisably, consult an EB-5 attorney and also the regional center in question before you pursue the request.

Immigration attorneysThere is no such thing as expedited processing. One or two regional centers have said they got cases approved in 3 months. Not in the last few years.

Lynne Feldman
Immigration attorneysThere is only an expedite if the regional center has been approved for expediting. I know of only one regional center with this designation.

Immigration attorneysUSCIS has expedited criteria listed on its website. There is no guarantee that any particular petition, including an I-526 petition, will be expedited. Many EB-5 projects have financial considerations and desires to receive a quick I-526 petition approval, but my sense is that very few petitions are actually expedited by USCIS absent extraordinary circumstances. There is no specific form for expedite requests; just submit a simple request letter explaining the reason for the expedite request along with supporting documents.
