Is it possible to apply for the EB-5 visa if I have already applied for an immigrant investor program in another country? I have the funds available, and feel EB-5 would be a faster choice. Would I need to withdraw my other application? How can I apply for EB-5 if I already applied for an investment immigration program in another country?

Immigration Attorneys DirectoryYou may apply for EB-5 even if you have applied as an investor in another country. You do not need to withdraw your application. You must meet all of the requirements for EB-5 classification, just like another investor seeking an EB-5 green card.

Immigration Attorneys DirectoryHaving participated in another country''s investor visa program does not automatically bar you from also putting in an EB-5 application in the United States. For example, you can have both investor visas processed, then make a final decision as to which one to follow through. However, if you have already obtained the permanent residency from Country A and now wants to do EB-5 in the U.S., you might run into problem with Country A, as it may perceive the U.S. EB-5 application as your intention to abandon Country A''s Residency.

Immigration Attorneys DirectoryApplying for the investor visa in a country other than the United States does NOT bar you in any way or form from applying for an investor visa in the United States too. As long as you have the funds and the lawful Source of Funds is well documented, you are good to go.

Immigration Attorneys DirectoryWhether or not you applied for an Investor Visa Program is another country is not relevant to the EB-5 application you wish to make. If you have the funds, and have the necessary documents to prove the source of funds, then you can invest in an EB-5 program either via a regional center (TEA Project at $500,000) or as a direct investment (at $1 million level) You should consult with an immigration attorney well-versed in EB-5 issues to give you proper guidance.
