How can I determine EB-5 attorney success rates?

Attorneys do not publish success rates.

There is no web page or statistics that keeps track of these info. You need to do your independent research as to each attorneys record.

I do not believe there is any way to judge attorney success rates. You can assess Regional Center success rates. If you pick a reputable attorney and have the necessary documentation, success will be tied to the regional center.

Before you hire any professional for a job, you should always look into his credentials and licenses. You should start with the Bar of your state and get a list of those that are certified as specialists in Immigration and Nationality law. You should also request information from the attorney and ask for referrals from prior clients. You should also google the attorney to see what they have done, written books, been on Immigration attorney forums, etc. And also get other additional information written about them. For example, the Miami Herald and Sun Times wrote a report about my experience with clients.

I do not believe there is a USCIS or State Department data base which tracts the success rates of Attorneys in respect to I-526 Petitions, applications for conditional permanent residency, or I-829 petitions. There are a number of credible EB-5 websites including this one which refer to dedicated EB-5 attorneys.I am sure the Attorneys referred to have approved petitions and applications. Hence, the next step is to have a conference call with the attorney(s) of your choosing and discuss there success rate. You will also be able to determine the compatibility of the attorney to your needs and timelines. In addition, the attorney you are consulting with should answer your questions of their success rate.

Most ethical attorneys will be clear about their success rates. "Success" can be defined as well in many ways so it is essential to be clear as to how you so define it. Further, "success" in an EB 5 context can be measured in various components such as I 526s, or regional centers or I 829 applications.

There is no independent data that will track this information. It would be best to discuss this with the attorney that you are interested in engaging.

Unfortunately there is no numbering system to do this kind of thing. But here are my suggestions. 1. Ask the attorney what percent of the work is done by paralegal vs. The attorney himself? You want most of the work done by the attorney. 2. Ask the attorney what was his college degree in for undergraduate? Decide if you would be comfortable someone doing this kind of work she he has studied history, political science, English, etc. Vs. Engineering or Business. 3. Ask the attorney if he has any investment experience? Has he ever started-up a company and been successful. Not a law firm, but a business other than a law firm.

I am not aware of a system which specifically rates EB-5 Attorneys.
